1. What Is the CAN-SPAM Act?

The CAN-SPAM Act (Controlling the Assault of Non-Solicited Pornography And Marketing Act) is a United States federal law enacted in 2003 that sets rules for commercial email messages. It gives recipients the right to stop receiving emails and establishes penalties for violations.

The law applies to all commercial messages — defined as any electronic mail message whose primary purpose is the commercial advertisement or promotion of a commercial product or service — including emails that promote content on commercial websites. It applies regardless of whether the sender is based in the United States if the recipients are located there.

3. Requirements We Enforce

In line with the CAN-SPAM Act, we enforce the following requirements across our platform:

  • Accurate Header Information — The "From," "To," "Reply-To," and routing information in every email must be accurate and correctly identify the person or business that initiated the message.
  • No Deceptive Subject Lines — Subject lines must not mislead the recipient about the content or subject matter of the message.
  • Identify Messages as Advertisements — If the email is an advertisement or promotional in nature, it must be clearly and conspicuously identified as such.
  • Include Physical Address — Every commercial email must include the sender's valid physical postal address (a street address, P.O. Box registered with the postal service, or a private mailbox registered with a commercial mail receiving agency).
  • Honor Opt-Out Requests — Every email must include a clear and conspicuous mechanism for the recipient to opt out of future messages. Opt-out requests must be honored within 10 business days.
  • Monitor Third-Party Compliance — Even if you hire another company to handle your email marketing, the law holds both the company whose product is promoted and the company that actually sends the message responsible for compliance. We actively monitor sending activity on our infrastructure.

4. Your Responsibilities as a Customer

When you use BulkEmailSetup infrastructure, you agree to the following responsibilities:

  • Maintain Clean Mailing Lists — Only send emails to recipients who have provided consent or with whom you have a legitimate business relationship. Never use purchased, scraped, or harvested email lists.
  • Honor Unsubscribe Requests Promptly — Process all opt-out and unsubscribe requests within 10 business days. Your opt-out mechanism must be functional for at least 30 days after the email is sent. You may not charge a fee, require additional personal information, or make the recipient take any steps beyond sending a reply email or visiting a single web page to opt out.
  • Include Your Physical Address — Every commercial email you send through our platform must contain your valid physical postal address.
  • Use Accurate Sender Information — Your "From" name, email address, and reply-to address must accurately represent your identity or your organization.

5. Anti-Spam Policy

BulkEmailSetup maintains a zero-tolerance policy toward spam. Spam — defined as unsolicited bulk email sent to recipients who have not given prior consent — undermines deliverability for all users on shared and dedicated infrastructure.

We actively monitor sending patterns, bounce rates, complaint rates, and spam trap hits across our infrastructure. If we detect activity that violates the CAN-SPAM Act or our acceptable use policy, we will take immediate action, which may include:

  • Temporary suspension of sending privileges
  • Permanent account termination without refund
  • Reporting the violation to the appropriate authorities

7. Consequences of Violation

Violations of the CAN-SPAM Act can result in severe consequences for both senders and service providers:

  • Service Termination — Your BulkEmailSetup account may be permanently terminated without refund if you are found in violation of the CAN-SPAM Act or our anti-spam policy.
  • Legal Liability — Each separate email in violation of the CAN-SPAM Act is subject to penalties of up to $51,744 under U.S. federal law. Additional fines may apply if the email involves deceptive practices or aggravated violations such as dictionary attacks or automated address harvesting.
  • Criminal Penalties — The most serious offenses — including accessing someone else's computer to send spam, using false information to register for email accounts, or relaying messages through unauthorized servers — can result in criminal prosecution and imprisonment.
